TERMS AND CONDITIONS

These General Terms and Conditions (hereinafter "GTC") apply to all orders placed via the online shop [DOMAIN.CH] of Tea Retail GmbH (hereinafter "Tea Retail" or "we"). The version valid at the time of the order is decisive. Deviating conditions of the customer are not recognized, unless we expressly agree to their validity in writing.

The presentation of products in the online shop does not constitute a binding offer, but rather an invitation to the customer to place an order. By completing the order, the customer submits a binding offer to purchase the selected products.

The receipt of the order will be confirmed by e-mail. This confirmation of receipt does not yet constitute acceptance of the offer. The contract is only concluded upon dispatch of the goods or upon a separate order confirmation.

We reserve the right to reject orders without stating reasons, particularly in cases of suspected misuse, unavailability of goods, or obvious errors in pricing.

All prices are in Swiss Francs (CHF) and include statutory VAT. Shipping costs are shown separately and are visible during the order process.

Payment can be made using:

• TWINT
• Credit card (via Stripe / Shopify Payments)
• Wallee

The charge will be made when the order is placed.

Retention of title: The goods remain the property of Tea Retail GmbH until full payment has been received.

Shipping is handled by Swiss Post exclusively within Switzerland and the Principality of Liechtenstein.

Shipping costs are a flat rate of CHF [AMOUNT]. For orders over CHF 100, shipping is free.

Delivery typically takes 2–4 business days from the order date. Information regarding delivery times is non-binding and does not constitute guaranteed characteristics.

The risk of accidental loss and accidental deterioration of the goods passes to the customer upon handover to the transport company.

For hygiene reasons and due to the nature of our products as food items, returns or exchanges of perfectly delivered goods are excluded.

Statutory warranty rights for material defects remain unaffected by this (see Section 8).

The statutory warranty provisions according to Swiss law of obligations (Art. 197 et seq. OR) apply. Upon receipt, the customer must inspect the goods immediately and report any defects immediately, but no later than 7 days after receipt, in writing (by e-mail to basel@palaisdesthes.com).

In the event of a justified complaint of defects, we have the right, at our discretion, to redeliver faultless goods or to refund the purchase price against return of the defective goods.

Tea Retail is liable for damages resulting from gross negligence or willful intent. Liability for minor negligence is excluded to the extent permitted by law. In particular, liability for indirect damages, consequential damages, and lost profits is excluded.

Liability for auxiliary persons is disclaimed to the extent permitted by law.

The processing of personal data is governed by our Privacy Policy.

Swiss law applies exclusively, to the exclusion of the United Nations Convention on Contracts for the International Sale of Goods (CISG).

The exclusive place of jurisdiction for all disputes arising from or in connection with this contractual relationship is Lucerne, Switzerland. Mandatory legal places of jurisdiction remain reserved.

Should individual provisions of these General Terms and Conditions be or become wholly or partially invalid, the validity of the remaining provisions shall not be affected. The invalid provision shall be replaced by a valid provision that comes closest to the economic purpose of the invalid provision.
